Kidney Patients - Appeals Karnataka High court

  • A petition seeking to relax legal hurdles in the way of timely transplants by Kidney Patients Welfare Association , was filed in the Karnataka High court .
    The petition stated that there were delays in grant and non-grant of permission to kidney transplants by the Authorisation Committee set up under the Transplantation of Human Organs Act 1994, and Rules 1995. So the petitioners has approached the High Court seeking facilities for ensuring timely treatment for patients suffering from kidney failure.
    It sought for mandating regular meetings of the committee to facilitate applicants for appearing and explaining their cases before it,court to direct the Union government and State department of Health and Family welfare for setting up a National and State Transplant Center for collecting, maintaining and disseminating information about the potential donors and recipients. Petitioner also called for Centralised Transplant Center with all facilities for carrying out organ transplant from cadaver sources .
    Moreover appeal was to facilitate dialysis centers in government hospitals at district headquarters of each district. Further it also demanded to set up facilities for preservation of organs of brain dead persons till they are transplanted to patients in need.
    The petition also challenged certain provisions of the Transplantation Act as being in violation of fundamental right to equality. The Division Bench comprising Justice P Vishwanath Shetty and Justice HG Ramesh, issued notices to the authorities and sought their statements within three weeks.
