Lecture on Organ Donation & Transplant Law by Life Member of MOHAN Foundation

  • On 11th March 2022, Department of Law, Dr. Ambedkar College, Deekshabhoomi, Nagpur, organised an online sensitization workshop on “Legal Aspects of Organ Donation and Transplantation” for students of its LLB 3 years and 5 years courses.  Mr. Devang Chhaya, Life Member, MOHAN Foundation was invited as the resource person for the workshop. Over 130 law students, senior faculty members and Head of Law Department Dr. Hema Menon attended the workshop.

    During the Workshop, two presentations were made. The first presentation aimed to spread awareness regarding Human Organs & Tissues Donation and introduce the participants to various concepts and aspects involved in donation and transplantation of human organs and tissues. Some of the issues covered in the presentation were (a) Difference between body donation and organ donation (b) Need for pledging and donating organs (c) Types of Donation: Living & Deceased (d) Various Organs & Tissues that can be donated by living and dead donors (e) Brain Stem Death: concept, main causes and certification process (f) Time window available for transplantation of organs from deceased donor; Green corridor etc. Participants were exhorted to consider pledging their organs and give a gift of life. They were also informed of the online process of pledging their organs and tissues and obtaining their donor card from www.mohanfoundation.org portal. 

    The second presentation introduced the participants to the salient features of ‘The Transplantation of Human Organs and Tissues Act, 1994 (as amended in 2011) (abbreviated : TOHO)’ and the legal aspects of its implementation. The presentation, inter-alia, covered salient provisions of the Act such as (1) The need for the Act (2) Objectives (3) Applications (4) Main legal definitions of the terms (5) Chapter 3 relating to authority for removal of organs and tissues  -  Sections 3, 4 and 9 were dealt in some detail (6) Constitution, Role and Functions of Authorization Committee and Appropriate Authority (7) Offences and penalities etc.

    The presentations were followed by question-answer session to clarify doubts and also dispel myths and superstitions surrounding organ donation.

    Mr. Devang complimented the college management and Faculty of Law, Dr. Ambedkar College, Deekshabhoomi, Nagpur for taking the lead amongst the Law colleges of Nagpur city in organizing the workshop to acquaint and educate their law students regarding the provisions of the TOHO Act and various legal aspects associated with its implementation. Through this workshop, this esteemed institution also contributed their mite in spreading awareness regarding the ultimate humanitarian gesture of Organ Donation amongst its students.
